These Terms of Service (“Terms”) govern your access to and use of SketchPad and related services. By using SketchPad, you agree to be bound by these Terms.
By creating an account or using SketchPad, you confirm that you are at least 13 years of age and agree to these Terms. If you are using SketchPad on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
SketchPad provides a cloud-based collaborative whiteboard and drawing tool. Features vary by subscription plan. We reserve the right to modify, suspend, or discontinue any part of the service at any time with reasonable notice.
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Notify us immediately at security@sketchpad.app if you suspect unauthorized access. You may not share your account with others or create accounts for the purpose of reselling access.
You agree not to use SketchPad to: (a) violate any applicable law or regulation; (b) infringe on intellectual property rights of others; (c) upload malicious code or interfere with the service; (d) collect data from other users without their consent; (e) impersonate any person or entity; or (f) engage in any activity that disrupts the service for other users.
You retain ownership of all content you create in SketchPad. By using the service, you grant us a limited license to store, display, and transmit your content solely for the purpose of providing the service. We will not access your canvas content except as necessary for technical support you request or as required by law.
SketchPad and its original content, features, and functionality are owned by us and are protected by international copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on our software.
Paid plans are billed in advance on a monthly or annual basis. Prices may change with 30 days notice. Refunds are available within 14 days of a charge if you have not used the paid features. All fees are exclusive of taxes. You are responsible for any applicable taxes.
You may cancel your account at any time from your account settings. Cancellation takes effect at the end of your current billing period. We may suspend or terminate your account for violation of these Terms, with or without notice. Upon termination, you will lose access to your canvases. You may export your data before termination.
SketchPad is provided "as is" without warranties of any kind. We do not guarantee that the service will be uninterrupted, error-free, or completely secure. We are not liable for any loss or damage arising from your use of the service.
To the maximum extent permitted by law, SketchPad shall not be liable for any indirect, incidental, special, consequential, or punitive damages. Our total liability for any claim arising from use of the service shall not exceed the amount you paid us in the 12 months preceding the claim.
We may update these Terms from time to time. We will notify you by email and via an in-app notice at least 14 days before material changes take effect. Continued use of the service after that date constitutes acceptance of the new Terms.
